Expulsion Process and Documents

So a student committed an 48900/48915 offense, or you have determined other means of correction have not worked, what do you do now? The clock is ticking for the moment you suspend. The whole process needs to be competed with in 40 days (unless and extension is requested by the parent in writing).

This document is your cover sheet for the Expulsion packet. It is internal and will not go home to parents. 

Process

Send to Student Services Coordinator with in 3 school days

Step 1: Reach out to Director of Student Services immediately- email with quick heads up. 
Include: Student name, ID, School site, Ed Code violation, and consequence.
  • Suspension notices needs to include "Student maybe be recommended for expulsion" If it is a 48915 it needs to say "student is being recommended for expulsion."
  • Parents need to be notified of recommendation with in 24 hours. 
Step 2: Send the Request for Extended Suspension.

Step 3: Send the Recommendation for Expulsion.

Step 4: Schedule the Manifestation Determination
  • Only if the student is in Special Education
  • Meeting must occur within 10 days of suspension. 
Step 5: Complete Expulsion Packet

Step 6: Prepare for the Hearing
  • Fill out the Expulsion Script
  • Prepare witnesses 
  • Make sure all your ducks are in a row.

Step 7: Day of Hearing
  • Come with Expulsion Script and packet
  • Double check the day before with witnesses (schedule them appropriately). 
Step 8: After Board Determination
  • If the recommendation is approved District will release/place the student. Registrar drops the student AFTER email from Student Support.
  • If the recommendation is not approved, student will return to site.
Step 9: Re-admission
  • Upon the readmission date the student can apply if all of their rehab plan has been met. 
  • Parents need to fill out the Re-admission request. 
  • It goes to the board- see step 7 for process.

Notes

  • The main reasons an expulsion does not go through are due to the following:
    • Due process not given- you have to meet with the student and get their side of what happened. If they refuse to write a statement note that on the witness form. 
    • Timelines are not met- watch your time, the clock starts the moment the student is suspended. 
    • IEP/Behavior plans were not being followed. 
  • ​Parents are scared of what is going to happen, be sure to explain to them that this is serious but it is a process. 
  • You can not expel a student on "hearsay." Witness have to appear in the hearing unless they have a true "fear" and have submitted the fear declaration. Names are not redacted from statements in an expulsion hearing. 
  • Parents have to be notified of the offense, suspension and recommendation in their identified home language. 
  • Be sure to keep any pictures, and get the Incident number from PD.
    • ​The police report needs to be included in the expulsion packet, be sure to request one early in the process, it can take a while for PD to get you one.
